Terms of Service

Welcome to Wahat Games! These Terms of Service (the “Terms”) are a legal agreement between you and Wahat Games FZ‑LLC (UAE), together with its parent Wahat Games Holding LTD (DIFC) (collectively, “Wahat Games,” “we,” “us,” or “our”). They govern your access to and use of our websites, games, applications, community spaces, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy (the “Privacy Policy”). If you do not agree, do not use the Services.

Quick summary (not a substitute for the full Terms): You must be old enough to use our Services, keep your account secure, follow community rules, respect our IP, and not cheat or harm the Services or others. We may update these Terms; continued use means you accept the updates.

1. Eligibility & Accounts

Age. You must be at least the age of digital consent in your country (13+, or as required by local law). Some games or features may have higher age ratings.
Account registration. You may need an account to access certain features. Provide accurate information and keep it updated.
Security. You are responsible for all activity under your account. Keep your password confidential and notify us immediately of suspected unauthorized use at contact@wahatgames.com.
Company use. If you use the Services on behalf of a company, you represent that you are authorized to accept these Terms on its behalf.

2. Licenses & Ownership

Our content. The Services, including games, software, artwork, music, logos, trademarks, and other content are owned by Wahat Games and/or our licensors and are protected by applicable laws. We grant you a personal, limited, revocable, non‑exclusive, non‑transferable license to access and use the Services for your personal, non‑commercial use, subject to these Terms and any game‑specific EULA.
Restrictions. You must not (and must not enable others to): copy, modify, reverse engineer, decompile, attempt to extract source code, circumvent security or DRM, sell, rent, or commercially exploit the Services except as expressly allowed by us in writing.
Third‑party content. Some Services may include third‑party content or libraries under their own licenses; those terms apply in addition to these Terms.

3. Purchases, Keys & Refunds

Where purchases occur. Purchases (e.g., game copies, in‑game items, subscriptions) may occur on third‑party storefronts (e.g., Steam, Epic Games Store, PlayStation, Xbox, Nintendo) or on our own websites. The applicable storefront’s terms, payment processing, and refund policies govern those transactions.
Refunds. Where a platform controls refunds, their policy applies. For direct purchases from us, unless otherwise stated: (a) digital content is typically non‑refundable once accessed, downloaded, or redeemed; (b) statutory rights (e.g., EU/UK withdrawal rights) are preserved where applicable (see Section 17).
Game keys. Keys we provide are for your personal use; resale or redistribution is prohibited unless expressly authorized by us.
Pricing & taxes. Prices are shown exclusive or inclusive of taxes as indicated at checkout. You are responsible for any applicable taxes, duties, or fees.

4. Subscriptions & Auto‑Renewal (if offered)

Billing. Subscriptions renew automatically at the then‑current price unless canceled per the instructions on the relevant platform or our website.
Cancelation. You can cancel at any time before the renewal date to avoid future charges. Access continues through the end of your current billing period.
Changes. We may change subscription features or pricing with prior notice. If you do not agree, cancel before changes take effect.

5. Community Rules & Acceptable Use

You agree not to use the Services to:

Harass, threaten, defame, or discriminate against others; or post illegal, harmful, or inappropriate content.
Upload or distribute malware, cheats, hacks, bots, automation, or perform DDoS or similar attacks.
Infringe IP or privacy rights, including unauthorized sharing of others’ personal information.
Impersonate any person or entity or misrepresent your affiliation with us.
Interfere with fair play, match integrity, or manipulate leaderboards.
Violate applicable laws, ratings, or age restrictions.

We may monitor, moderate, or remove content and may suspend or terminate access for violations.

6. User‑Generated Content (UGC) & Streaming

Your content. If you post, upload, stream, or otherwise provide content via the Services or related platforms (“UGC”), you grant Wahat Games a worldwide, non‑exclusive, royalty‑free license to use, reproduce, distribute, display, perform, adapt, and create derivative works from your UGC for operating, improving, and promoting the Services. You retain ownership of your UGC.
Representations. You represent you have all rights to your UGC and that it does not violate law or third‑party rights.
Streaming & monetization. We generally permit streaming and monetization of gameplay of our titles, including posting clips or “Let’s Play” videos, provided you: (a) include the game title and credit Wahat Games; (b) do not charge viewers for access to the raw game content itself; (c) do not distribute the game’s assets separately; and (d) comply with these Terms, platform policies, and any game‑specific guidelines. We may revoke this permission for any reason.
Reporting IP concerns. See Section 7 for takedown requests.

7. IP Notices & Takedowns

If you believe your rights have been infringed, please email contact@wahatgames.com with: (a) your contact details; (b) a description of the work and the location of the allegedly infringing material; (c) a statement of good‑faith belief and that the information is accurate; and (d) proof of authorization to act. We will review and respond in accordance with applicable law.

8. Health & Safety

Some games may include flashing lights or patterns that can trigger photosensitive epilepsy or other reactions. If you or anyone in your household has an epileptic condition, consult a physician before playing. Stop use immediately if you experience dizziness, nausea, disorientation, seizures, or similar symptoms.

9. Beta Features & Feedback

Betas. We may offer alpha/beta/preview features (“Beta Features”) for testing. They are provided “as is” and may be unstable or change at any time.
Feedback. If you submit suggestions, ideas, or feedback, you grant us a free, perpetual, irrevocable license to use them without restriction or compensation.

10. Third‑Party Services & Links

The Services may link to or integrate third‑party services. We are not responsible for their content, terms, or privacy practices. Your use of third‑party services is at your own risk and subject to their terms.

11. Suspension & Termination

We may suspend or terminate your access to the Services (and/or remove UGC) if you violate these Terms, create risk or legal exposure for us, or if required by law. Upon termination, your license ends and you must stop using the Services.

12. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Services will be uninterrupted, secure, or error‑free, or that defects will be corrected.

13. Limitation of Liability

To the fullest extent permitted by law, Wahat Games and its affiliates, officers, employees, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of the Services, even if advised of the possibility. Our total liability for any claims relating to the Services will not exceed the greater of (a) USD 100 or (b) the amount you paid to us for the specific Service giving rise to the claim in the 12 months before the claim. Some jurisdictions do not allow certain limitations; in such cases, those limitations apply to the maximum extent permitted.

14. Indemnity

You agree to defend, indemnify, and hold harmless Wahat Games and its affiliates, officers, employees, partners, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the Services; (b) your UGC; (c) your violation of these Terms; or (d) your violation of any law or third‑party rights.

15. Governing Law & Dispute Resolution

Law & forum. These Terms and any dispute or claim (including non‑contractual disputes or claims) are governed by the laws of the Dubai International Financial Centre (DIFC), without regard to conflict‑of‑laws principles. The courts of the DIFC will have exclusive jurisdiction.
Alternative (optional): Arbitration. Alternatively, disputes may be finally resolved by arbitration under the Dubai International Arbitration Centre (DIAC) Rules by one arbitrator seated in Dubai, with proceedings in English. If you prefer court jurisdiction, delete this arbitration option.
Consumer rights. Mandatory consumer protections applicable in your country of residence prevail where required by law.

16. Changes to the Services or Terms

We may modify the Services and these Terms at any time. Material changes will be notified by posting an updated version with a new “Last updated” date and/or by other reasonable means. Your continued use after changes take effect constitutes acceptance of the revised Terms.

17. Region‑Specific Terms (Informational)

EU/UK consumers: For digital content purchased directly from us, you may have a statutory right to withdraw within 14 days of purchase unless downloading/streaming begins during that period with your prior consent (in which case the right may be lost). This section does not change platform‑store policies (e.g., Steam, PlayStation), which apply where the purchase was made.

18. Miscellaneous

Entire agreement. These Terms and any game‑specific EULA or supplemental terms are the entire agreement between you and Wahat Games regarding the Services.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign or transfer any rights or obligations under these Terms; we may assign them to an affiliate or successor.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
